I have to deal with second hand smoke from neighbors on both sides of me. It gives me a headache, makes my eyes water and gives me a runny nose, not to mention that it makes MY apartment stink. I have tried purifiers, closing vents, etc and nothing works. My lease is not up until November. Is there a way to get out of it early due to the smoke?
I have complained through 3 managers….the result was always “Nothing we can do”

    the only thing you can do is talk to the leasing manager at your apartments. if they are a good person, and if the company gives them the leeway they may be able to let you out of your lease. it’s not a common thing, but if you explain that it is for medical purposes that you need out they may help you out.

    unfortunately, you did sign a lease. so they are not obligated to let you leave. but that “medical reasoning” excuse may do it.

    You may have the order of smoke but you don’t have smoke in your apartment. Go talk to the management and ask if you can be placed in a non-smoking building if they have one. If they can’t, or don’t want to do that your stuck until November, depending on the state, county, and city you live in. (Laws vary)

    Not unless your lease calls for a smoke-free environment. However, there’s nothing wrong with presenting your case to the management.

    You can call the police about it in California.

    Anyone saying you don’t have smoke, only “odor” is an idiot. Those are toxins and they do go through just about anything.

    Talk to your apartment manager about the problem, as you are certainly having a reaction and can not defend yourself. They should allow you to either move to another unit if they are unable to release you from your lease. It would be very easy for them to verify that you are surrounded with smokers.

    A one year lease that is up in November—It is March — why did you not complain in November or December about the smoke. Because of longivity all you can do is see if the LL will let you out of the lease. You do not have to live in the apt but you do have to pay the rent… If you break the lease then the LL has an obligation to rent the apt. Or if you can provide a renter that would work in your favor…

    Good finance question! I know of an organization that gives up to $1500 to people to help them with their rent or mortgage. It’s available in most US cities, I highly suggest you check it out.

    I would recommend the purchase of a product called Liquid A$$. Spray this stuff as near as possible to the source and they might reconsider what they are doing.
